In respect of the implementation of the provisions of Regulation No 2016/679 of the European Parliament and Council (EU) from the 27th April 2016 on protection of physical persons with regards to personal data processing and free flow of such data, while repealing Directive No. 95/46/EC (referred to as General Data Protection Regulation – GDPR), the Gerda Sp. z o.o Company, with its registered Office in Sokolow, gives you a set of necessary information about your personal data processing rules and about your rights, associated with the subject matter.

Who will be the administrator of your data?
Your personal data will be administered by the Gerda Sp. z o.o Company, with its registered Office in Sokolow, ul. Sokolowska 49, 05-806 Komorow.

What data are processed by us?
Regarding the scope of commercial communication covering issues, we collect and process the information on your data, obtained from you during:
• filling in of forms or questionnaires;
• phone calls;
• e-mail correspondence.

For what purpose and on what grounds will your personal data be processed?
We are going to process your data:
a) exclusively under your consent (Art. 6 section 1 letter a of GDPR) for the purposes to present you the commercial offer of Gerda and, in particular:
• to have an e-mail or telephone contact with you;
• to recognise your needs and expectations;
• to keep you updated with Gerda’s actual offers;
• to keep you updated with Gerda’s actual promotions;
• to enable you to make use of the Partner’s zone;
• to enable you receiving our newsletter;
b) to fulfil the justified interest of the data administrator (Art. 6 section 1 letter f of GDPR), e.g. when specifications, analyses, statistics or reports are issued for direct marketing purposes, as well as to ensure data safety.

Whom do we disclose your data to?
We may disclose your data in the scope in which it is necessary to:
a) to entities authorized to receive such data under applicable laws (e.g. courts, legal protection authorities, administrative authorities and supervising authorities);
b) to entities which process your data on our behalf (e.g. to outsourced entities which handle our communication and IT systems or which provide us communication and IT tools, to providers of advisory and counselling services, to research agencies, etc.);
c) in every case your data are disclosed, we shall ensure that the disclosed information will only include a minimum of the information, necessary to achieve the purpose of data processing.
Your data will not be transferred beyond the area of the European Economic Area (EEA). In case, when your data were to be transferred beyond the EEA’s boundaries, we shall do our best to ensure that our cooperation with such entities was founded on appropriate legal bases and that those entities guaranteed appropriate data protection standards.

How long shall we store your data?
We shall store your personal data for a period not exceeding that necessary for the purpose for which they are collected or processed; to the extent necessary to ensure compliance with the applicable legal requirement or in the scope in which it is indicated under applicable, archivisation-related laws.
In case of your data processing, carried out on the basis of your consent, we shall store your data for the period till your consent is withdrawn and, after that, for a period and in the scope required to pursue by Gerda a legitimate interest of the data controller.

What are your rights with regards to your data processing?
Remember that you are entitled to:
a) access the contents of your personal data, including the right to obtain copies of these data;
b) demand rectification (amendment) of your personal data, when the data are incorrect or incomplete;
c) demand to delete your personal data (acc. to the, so-called, “right to be forgotten”) – in case, when: (i) the data are no longer necessary for the purposes for which they have been collected or otherwise processed; (ii) you have filed an objection against your data processing; (iii) you have withdrawn your consent for your data processing, while there is no any other legal basis to continue the process; (iv) the data are unlawfully processed; (v) the data have to be deleted in order to comply with the obligation under relevant laws;
d) demand your personal data processing to be restricted in case when: (i) you call into question the accuracy of your personal data; (ii) the data processing is incompatible with the law, while you will object to have the data deleted, demanding their restriction instead; (iii) we shall not need your data for our purposes, while you will need the data to determine, defend or investigate your claims; (iv) you have submitted an objection against the data processing – till it is established if the legitimate grounds on the part of the administrator take precedence over the grounds for objection;
e) transfer your personal data in case, when: (i) the processing is carried out on the basis of an agreement with you or your provided consent; (ii) the processing is carried out in an automatic way;
f) submit an objection against your personal data processing, including their profiling, when: (i) any causes occur, associated with your particular situation and (ii) your data processing is based on the grounds of their necessity to execute the legitimate purposes of the administrator.
g) to withdraw your consent to your data processing in the scope in which you have previously provided it for personal data processing at any time without affecting the compliance with the right to process the data, executed on the basis of your consent prior to its withdrawal.
In addition, you are entitled to submit your complaint to an appropriate supervisory authority, i.e. to President of the Personal Data Protection Office in case when you consider that our processing of your data infringes the provisions of the General Data Protection Regulation (GDPR).

Profiling
The data, acquired from you, may undergo profiling.

Do you have to provide your data?
Providing your personal data is entirely voluntary. Failure to provide your data will, however, result in our inability to present you the commercial offer of Gerda.
